CHARGES

  • First-degree trespass involving a law enforcement officer or relative — Class A misdemeanor

The trouble began three days earlier—but not with Helfer.

On Friday, October 9, an Elsberry officer arrested Helfer’s adult son for several traffic violations and had his motorcycle towed.

By approximately noon Monday, the issue had reached the officer’s private residence. Helfer arrived at the home and began pounding on the front door. The officer saw him through a camera and recognized him as the father of the man he had arrested.

The officer’s wife was the first to encounter Helfer. She stepped from the house into the garage, where the overhead door was open, and instructed him to leave. She also told him that any police business needed to be handled through the Elsberry Police Department or City Hall.

Helfer did not leave. He remained in the garage area and continued staring at her.

Concerned for his wife’s safety, the officer came outside and confronted Helfer near the threshold of the open garage.

The officer ordered Helfer to leave approximately six times in a loud and commanding voice. Helfer continued refusing and staring at him.

The officer reported that he then “forcefully charged at Helfer” while continuing to order him off the property. Helfer finally turned and began walking toward a vehicle parked in the driveway.

As he walked away, Helfer said, “Now I know what my son was talking about.”

Even then, the confrontation was not over.

Helfer entered the vehicle but did not immediately leave. Still concerned for his safety and the safety of his wife, the officer opened the driver’s door and again ordered Helfer away from the residence. Helfer then drove away.

The officer’s wife reported that she feared for her safety during the encounter and wanted charges pursued.

Helfer was arrested at approximately 12:38 p.m. that same day. He was taken to Mercy Hospital Lincoln for a fit-for-confinement examination before being transported to the Lincoln County Jail and placed on a 24-hour hold while authorities sought a warrant.

A warrant was issued Tuesday charging Helfer with first-degree trespass involving a law enforcement officer or relative. Bond was set at $5,000 cash only.

If released, Helfer must have no contact with the victims or any co-defendants, must be placed on GPS monitoring and must remain at least one mile away from the victims’ location.

Helfer remained in custody at the time of publication.
