CHARGES
Third-degree domestic assault — Class E felony
The victim told an investigating officer that he and his son had been at a friend’s house when an argument escalated into a physical confrontation.
He described his son removing his hat and throwing it to the ground. When he moved to retrieve it, Weiss allegedly began punching him in the face with a closed fist.
As the victim tried to cover his head, he said Weiss pulled his shirt upward and over his head. The neckline constricted his throat, obstructing his airway and depriving him of breath for several seconds.
The struggle left the victim with a cut to his ear and facial swelling. The responding officer documented those injuries and described them as consistent with his account.
Weiss gave a different version of the encounter, telling the officer he restrained his father but never struck him.
The reported assault occurred around 9 p.m. Weiss was arrested at approximately 9:40 p.m.
The felony charge alleges third-degree domestic assault. No separate strangulation charge is listed in the supplied warrant.
Judge Yelton signed the no-bond warrant October 21. It was served that morning at approximately 9:36 a.m.
The order directs that Weiss remain detained pending trial, finding that no combination of monetary or other release conditions would ensure the safety of the community or another person.
The case is filed in Warren County Circuit Court under No. 26BB-CR00777.
